Terms and Conditions

Agreement between Mary van den Berk, owner/operator of Tribute-Art (hereinafter referred to as “Tribute-Art”), and You, the authorised representative of  “The Client” (hereinafter referred to as “The Client”), for work commencing in the capacity of artist providing an oil painted portrait with a digital background (33 x 23 cm) with options of a photo-book or a presentation book containing the military history prepared by a military historian.

AGREED RATE – The agreed rate for work carried out is at set prices as follows:

  1. A customised, oil painted, framed portrait in standard frame  $400
  2. A customised photobook only regular portrait or landscape (20 pages which includes 4 A4 text pages, with a word limit of 2000 words and up to 30 images) $700
  3. A customised, oil painted, framed portrait plus a photo book ( of 20 pages which includes 4 A4text pages, with a word limit of 2000 words and up to 30 images) $950 or
  4. A customised, oil painted, framed portrait plus a presentation book outlining the military history and including family information and photographs $1950. A set template is used for the presentation book of 20 pages in length, with a word limit of 5000 words and contains maximum 30 images including family photographs.

Additional pages and images are charged on a per page basis to be confirmed in writing prior to commencement.

Your order is secured when you pay a 50% deposit of the final package amount ie $200 -$975 dependent on package selected.

Additional presentation books can be ordered from momento-pro direct at a cost of approximately $85 each for the standard model plus postage. Prices can differ depending on memento-pro costs.

In addition to the presentation table book and photographic or painted art portrait:

Additional pages and images are additional cost as agreed and signed off.

Larger art- works can be ordered at additional cost ie 40x50cm or larger.

Photographic prints of the completed artwork on archival paper can be ordered

Framing is provided in one format: a silver/gold frame. Finished size 23cm wide x 33 cm high. Other formats and sizes available with additional cost.

The whole process takes around 12 weeks. At approximately 4 weeks after you have placed an order you will receive research information in point form and images of the background for the portrait to make a final selection. A final draft will be sent to you prior to printing for any additional comments or amendments.

 

Tribute-Art reserves the right to change this rate periodically. The Client will be informed in writing should this rate be changed during the term of this agreement.

PAYMENT – Tribute-Art invoices 50% before commencement. Payment by The Client is required within 7 (seven) days of receipt of invoice from Tribute-Art. Tribute-Art accepts payment by direct deposit and the bank account details will be made available to you when the invoice is sent.

CONFIDENTIALITY –Tribute-Art agrees not to misuse or disclose any confidential information that may be made available by The Client.

CLIENT RESPONSIBILITIES –Tribute-Art is under the responsibility of The Client from the time of reporting for duties, and throughout the booking. All reasonable care will be taken to ensure work is completed to the highest achievable standard however Tribute-Art will not be held liable for loss, expense or damage caused by any act or omission that occurs throughout the duration of the booking.

ARTWORK APPROVAL, ERRORS AND OMISSIONS –Tribute-Art will take all reasonable care to check proofs carefully for accuracy in all respects, ranging from spelling to technical illustrations. However, it is considered the responsibility of The Client to check all artwork carefully before final sign off and publishing. As a result, Tribute-Art is not liable for loss, expense or damage caused by any act or omission.

NATURE OF COPY – The Client agrees to exercise due diligence in its direction to Tribute-Art regarding preparation of materials and must be able to substantiate all claims and representations. The Client is responsible for all trademark, service mark, copyright and patent infringement clearances. The Client is also responsible for arranging, prior to publication, any necessary legal clearance of materials Tribute-Art prepares. Tribute-Art will not be held liable for any legal infringements as a result of artwork being distributed or published under the direction of The Client.

LIABILITY –Tribute-Art makes every effort to maintain the highest possible work standards, however cannot accept responsibility for any loss, expense or liability of any kind incurred whilst preparing work for The Client in a freelance capacity. To the extent permitted by law, Phase Creative shall not be liable to the Client or to any third party for any loss or damage arising directly or indirectly in connection with the provision of services. The Client will indemnify and holds harmless the Consultant from and against any claims, costs, expenses, negligence, actions or suits suffered, sustained or incurred by the Client or any third party. This includes, without limitation, interruptions caused by acts of Nature, or any other circumstances beyond reasonable control, any lost profits, business interruption, loss of data or otherwise, even if expressly advised of the possibility of such damages.

CANCELLATION / TERMINATION OF AGREEMENT – Should The Client wish to cancel/terminate the agreement and discontinue any work in progress, The Client must notify Tribute-Art immediately of this intention. Hours worked to that point will be invoiced (minimum 4 hours at $120 per hour). In the case of cancellation/termination, outstanding invoices are required to be paid within 7 (seven) days of the invoice issue date.

VARIATION IN TERMS – These terms can only be varied, amended or altered by written agreement between Tribute-Art and The Client.
